A Los Angeles sex crime trial for the 20th president of the #Metooo movement. The case for Harvey Weinstein is still unsolved
Harvey Weinstein, once one of the most powerful men in Hollywood whose many sex crimes helped ignite the #metoo movement, was convicted of 3 of 7 charges in his second sex crimes trial, this time in Los Angeles. 3 of the charges were not able to be decided by the jury. The man is currently serving a sentence for rape and sexual assaults in New York.
The trial will be held at the Clara Shortridge Foltz Criminal Justice Center. It’s expected to last eight weeks, according to The Associated Press.
If Weinstein is found guilty in Los Angeles he could face up to 60 years to life in prison.
In October 2017, The New York Times and days later The New Yorker published exposes into allegations that Weinstein had attacked dozens of women over several years. Allegations of this nature were often whispered about, even joked about, but never brought to light in this way before.
Weinstein denied all wrongdoing and did not testify during the trial. His attorneys argued that one of the women had agreed to sex with Weinstein in order to advance their careers in Hollywood. Weinstein’s lawyer, Mark Werksman, told the jurors that Weinstein’s actions were part of acasting couch culture.
Two sketch artists are able to be in the courtroom daily, according to the AP. In New York, dozens were allowed inside to monitor the trial.

Before he was kicked out of the Academy of Motion Pictures Arts and Sciences, movies produced or distributed by those companies were at one point nominated for more than 340 Academy Awards.
The jury acquitted Weinstein of a charge of sexual battery against another woman. A jury in California was not able to agree on the guilt of two other women, and one counts rape and sexual battery by restraint, whichInvolves the first partnership between a governor and a film director.
The deputy district attorney in the Weinstein case described him as a “predator” who used his status in the film industry to force women into private meetings that turned violent. For more than a month in court, eight former models and actors vividly described Weinstein attacking them in various hotel rooms.
“She intends to testify at his trial to seek some measure of justice for survivors and as part of her life’s work to improve the lives of women,” Fegan said.
The jury has been working on the case for a period of time. This jury has deliberated for longer than the New York jury in Weinstein’s first criminal trial, in which he was convicted him of criminal sex act and third-degree rape after 26 hours of deliberations.
Just a day after The New York Times published its bombshell report on Weinstein in October 2017, Newsom wrote an opinion editorial for the Huffington Post where she shared that she had an experience very similar to the allegations reported by the Times.
“I was naive, new to the industry, and didn’t know how to deal with his aggressive advances ― work invitations with a friend late-night at The Toronto Film Festival, and later an invitation to meet with him about a role in The Peninsula Hotel, where staff were present and then all of a sudden disappeared like clockwork, leaving me alone with this extremely powerful and intimidating Hollywood legend,” Newsom wrote.
Siebel Newsom is a Stanford University graduate who has written, directed and produced several documentaries, including “Miss Representation,” “The Mask You Live In” and “The Great American Lie.” During her time as California’s First Partner, Siebel Newsom has advocated for working mothers and launched initiatives focused on closing the pay gap, among other efforts, and has been involved in several social activism campaigns.

He has denied all of the charges against him. He had 11 charges brought against him, but four of them were dropped when the unnamed woman did not testify.
In closing arguments, Los Angeles County deputy district attorney labeled Weinstein a “titan” and called him to account for his crimes.
Weinstein’s attorneys said there is no evidence of assault, that the allegations were fabricated or that they happened consensually.
Gloria Allred said in a news conference that Lauren Young told her that she was happy that Weinstein was found guilty on some counts despite a mistrial on her count.
Each morning at trial, Weinstein was brought from a correctional facility and wheeled into the Los Angeles courtroom wearing a suit and tie and holding a composition notebook.
Siebel Newsom said that the man in the blue tie was staring at her before the most emotional moment of the trial. She testified that Weinstein raped her in a hotel room in 2005.
Defense attorney Jackson asked the jury if they could accept what the Jane Does say, saying there wasn’t sufficient forensic evidence to support their claim.
“Five words that sum up the entirety of the prosecution’s case: ‘Take my word for it,’” Jackson said. He arrived at the hotel room without warning, so I took my word for it. Take my word for it, I was there at his hotel room. I didn’t consent, take my word for it. Take my word for it, that I said no.’ I think so.
Siebel Newsom described an hourslong “cat-and-mouse period,” which preceded her alleged assault. She, like other accusers, described feeling “frozen” that day.
Women’s rights lawyer Gloria Allred, who is representing Jane Doe 2 in the case, told CNN she hopes the jury sees her client “has no motive at all to do anything but tell the truth.”
“She never sought or received any compensation … She no longer lives in California. But she is testifying because she’s been asked to testify and I hope that they see her as the young woman that she was when she met Harvey Weinstein, and the woman that she is today approximately nine to 10 years later. Her life has changed,” Allred said.
“To be willing to subject yourself to what could be a very brutal cross-examination. It takes a very special person to do that. And she is a special person. I’m very proud,” Allred said.
Weinstein is obviously disappointed, however hopefully because of this particular accuser there are good ground to appeal based on time and location of alleged events. He is prepared to keep fighting the other counts despite the fact that he was found not guilty on the other counts.
The movie mogul was found guilty of rape, forcible oral copulation and sexual penetration by foreign object, all charges that were brought by a model who said he attacked her in a Beverly Hills hotel room.

Elizabeth Fegan was disappointed that the jury couldn’t reach a unanimous verdict on charges related to her client.
Jurors will return to court Tuesday to consider aggravating factors to help determine the outcome of Weinstein’s sentencing hearing, according to the DA’s office.
Young said in a statement that Weinstein can no longer use his power to intimidate and sexually assault women after he was convicted.
The name Harvey Weinstein is synonymous with sexual predator. In the years since Mr. Weinstein’s downfall it was argued that other serial abusers were not as bad as him.
But in many places, Mr. Weinstein’s notoriety is not supposed to matter if you are selected to serve on a jury in a trial of his crimes. The jury is typically told to decide the case on its own facts. How much information prosecutors are able to give the jury about the accused’s past is an open topic of heated debate. That question deserves a close look now, following Mr. Weinstein’s conviction on Monday of rape and other crimes in Los Angeles, and his conviction in 2020 of other crimes in New York.
Limits have limits of their own. As former prosecutors who handled cases involving many types of serious crimes, including sexual assault, we think trials for sex crimes are different from other trials, and these differences must be reflected realistically in the rules of evidence.
Weinstein’s defense tried to discredit the women’s testimonies as “untrustworthy,” and during closing arguments, attorney Alan Jackson referred to them as “fame and fortune seekers.”
Natassia Malthe, the model and massage therapist who was identified as “Jane Doe”, alleged that she was attacked inside a London hotel.
The accusers said that Weinstein had a surgery in 1999 that made his genitalia appear abnormal.
Italian model Ambra Battilana Gutierrez was a witness during the trial, testifying about his “prior bad acts.” She filed a police report in order to force prosecutors to investigate Weinstein. Gutierrez was part of a sting operation for the New York Police Department; she agreed to wear a wire to record Weinstein. The recording was played for Los Angeles jurors when the Manhattan district attorney did not prosecute him.
The news caused people to become aware of sexual abuse and sexual harassment in the workplace and society as a whole. That movement has exposed sexual misconduct by very powerful men in business, politics and entertainment.
