Robert Hur, the special counsel who investigated the handling of classified information by President Biden, is expected to testify on Tuesday before the Congress, the first time he’s spoken publicly about the investigation.
Put aside for the moment that Hur could not explain why he needed to speculate at length about Biden’s memory and cognitive functioning, since he admitted he didn’t have sufficient evidence to recommend charges in the first place. Why did he not report his own statement that Biden appeared to have a photographic understanding and recall, if it was important to take the president’s memory into account?
Democrats on the committee are likely to use Hur’s appearance to draw a sharp contrast between Biden and Trump, who look set for a rematch in the 2024 presidential race.
Republicans seized on the description of Biden to question the president’s mental acuity. The Speaker of the House, Mike Johnson, said that a man who was incapable of being held accountable for handling classified information was definitely not qualified for the Oval Office.
Johnson and other GOP leaders in the House claim that the decision not to charge Biden was proof of a two-tiered system of justice.
The investigation into Trump’s alleged mismanagement of classified documents is led by special counsel Jack Smith. Trump was indicted on more than thirty federal criminal charges after boxes of classified materials were found in his Mar-a-Lago residence.
Although the Biden and Trump cases both involve classified materials, there are significant differences between them. In Biden’s case, his attorneys promptly returned the records after discovering them. Trump, meanwhile, is accused of willfully keeping the classified documents and then actively trying to obstruct Justice Department efforts to get them back.
Serious facts would be presented by the allegations against Mr. Trump if they are proven.
The investigation, led by Reps. Jim Jordan, R-Ohio, and James Comer, R-Ky., has continued for months without producing any direct evidence that Biden was involved in any of his family’s foreign business dealings.
