The family of cinematographer Halyna Hutchins has reached a settlement with Alec Baldwin and other Rust producers over her shooting death on the film set last year.
The film’s production companies, its producers, and other key members of the crew were accused of numerous industry standard violations in the lawsuit filed in Santa Fe.
“Throughout this difficult process, everyone has maintained the specific desire to do what is best for Halyna’s son,” Baldwin said in an Instagram post Wednesday morning. Everyone who contributed to the solution of the situation has been thanked.
“In my own attempts to heal, any decision to return to finish directing the film could only make sense for me if it was done with the involvement of Matt and the Hutchins family,” Souza said.
Rust Movie Productions, LLC, through its attorney, Melina Spadone of Pillsbury Winthrop Shaw Pittman, said: “We are pleased the parties came together to resolve this matter, which, subject to court approval, marks an important step forward in celebrating Halyna’s life and honoring her work.”
The lawsuit also claimed the production companies and producers “cut corners” and “chose to hire the cheapest crew available,” specifically noting that they “knowingly hired a wholly unqualified armorer,” and required her to split time in a second role as assistant props master.

“Hannah is grateful that this settlement will benefit the Hutchins family and that the parties were able to constructively resolve the civil lawsuit. The district attorneys office will accept that a measure of justice has been achieved in regards to the tragic accident, and will not attempt to pursue criminal charges.
A spokesperson for the Santa Fe District Attorney told CNN in a statement that the settlement agreement would not impact the ongoing criminal investigation in the case.
“While civil suits are settled privately and often involve financial awards, criminal cases deal only in facts,” Heather Brewer, spokesperson for the Office of the First Judicial District Attorney of New Mexico, said in a statement. If the facts warrant criminal charges in New Mexico, they will be brought. No one is above the law.

Under the settlement, which is subject to court approval, the filming of Rust will continue with the “original principal players on board” and Hutchins’ husband Matthew will serve as executive producer.

Baldwin is seeking “compensatory, nominal, statutory, and punitive damages” through a jury trial, litigation-related expenses, and other relief to be determined by the Los Angeles County Superior Court, the cross-complaint says.

The parents and younger sister of Halyna Hutchins, who is a nurse in the Ukranian capital city of Kyiv and married to a Ukrainian man fighting in Russia, filed a lawsuit against Baldwin in Los Angeles County Superior Court.
The new lawsuit alleges negligence and the depravation of benefits, based on the emotional or financial support that Hutchins previously provided to younger sister Svetlana Zemko and parents Olga Solovey and Anatolii Androsovych. The lawsuit also names as defendants a long list of “Rust” crew members, an ammunition supplier, producers of the film and affiliated businesses.
The Involuntary Manslaughter Case Against Baldwin and the Weapons Supervisor (Halyna) Gutierrez-Reed
Separately, Baldwin and weapons supervisor Hannah Gutierrez-Reed are confronting felony criminal charges of involuntary manslaughter in New Mexico District Court, with a remote first appearance scheduled later this month in which pleas may be entered. Baldwin and Gutierrez-Reed have vowed to dispute the charges, while an assistant director has agreed to plead guilty to lesser charges.
Los Angeles-based attorney Gloria Allred described Zemko as a working emergency operating-room nurse who is raising an infant and 4-year-old child while her husband fights in the war.
At a news conference, Allred said that Zemko “had a very close and loving relationship with her big sister, Halyna, and she feels strongly that anyone who is responsible for her loss must be held accountable.”
New Mexico state law has provisions regarding the loss of consortium, which is one of the reasons why the lawsuit against Baldwin was filed in California.
