Alec Baldwin is trying to clear his name after being killed in a movie.

Baldwin has filed the cross-complaint against the production’s armorer, the assistant director, the prop weapon and the company Kenney, which is listed as a defendant in the lawsuit.

Halyna Hutchins died shortly after being wounded during rehearsals at a ranch on the outskirts of Santa Fe on Oct. 21, 2021. Baldwin was pointing a pistol at Hutchins when the gun went off, killing her and wounding the director, Joel Souza.

Cross Defendants owe a duty to those on set to keep the set safe. Baldwin was the one who trusted them to do so. Hutchins never would have instructed Baldwin to point the gun in her direction and pull back the hammer if she thought the slightest possibility existed that it was loaded; Baldwin, who shared the same state of mind as Hutchins in that critical moment, wouldn’t have done so under such conditions,” the lawsuit claims.

Baldwin has maintained he was not aware the gun he fired during a rehearsal contained a live round. In a statement to CNN on Jan. 19, his attorney called the prosecutors’ decision “a terrible miscarriage of justice.”

Baldwin is seeking “compensatory, nominal, statutory, and punitive damages” through a jury trial, litigation-related expenses, and other relief to be determined by the Los Angeles County Superior Court, the cross-complaint says.

In his cross-complaint, Baldwin says that while working on camera angles with Hutchins during rehearsal for a scene, he pointed the gun in her direction and pulled back and released the hammer of the gun, which discharged.

Hutchins died shortly after being wounded during setup for a scene in a western movie called “Rust” at a film set ranch on the outskirts of Santa Fe.

The statement said Mr. Baldwin had no reason to believe there was a live bullet in the gun. He relied on those who worked for him.

New Mexico’s Office of the Medical Investigator determined the shooting was an accident. Criminal charges should be filed if the prosecutors review the shooting.

In April, New Mexico’s Occupational Health and Safety Bureau levied a maximum fine of $137,000 against Rust Movie Production for their role in the fatal shooting of a crew member.

Hutchins’ family said in October that they had agreed to resolve the lawsuits against the actor and the producers and that they hoped to resume the movie project in January.

A lawyer for Baldwin was reviewing his lawsuit. The New York Times reported that attorneys didn’t respond to requests for comment.

Baldwin and Reed are both facing two counts of manslaughter and a jury can determine which count is more appropriate, according to Carmack-Altwies.

“Negligent use of a deadly weapon charges were also filed against ‘Rust’ assistant director David Halls, who has pleaded no contest and has entered into a plea agreement that is pending approval,” according to a media statement issued by the DA’s office.

Mary Carmack-Altwies said in a statement that they took another important step in securing justice for Halyna Hutchins. “In New Mexico, no one is above the law and justice will be served.”

The manslaughter indictment against Baldwin and Hannah Gutierrez-Reed on the Western Rust is “terrible”

The training session for at least an hour or more in duration was scheduled, but the actual training consisted of only about 30 minutes and Baldwin was distracted and talking on his cell phone to his family during the training.

“We were expecting the charges but they’re absolutely wrong as to Hannah – we expect that she will be found not guilty by a jury and she did not commit manslaughter,” attorney Jason Bowles said in a statement to CNN earlier this month when the indictment was first released.

But one count would involve a firearm enhancement, or an added penalty, because a firearm was involved. It could involve up to five years in jail for the crime, prosecutors said.

Santa Fe District Attorney Mary Carmack-Altwies filed the charging documents naming Baldwin and Hannah Gutierrez-Reed, who supervised weapons on the set of the Western “Rust.”

Baldwin’s attorney didn’t make any comment on Tuesday, but referred to his previous statement on the case in which he called the charges a “terrible miscarriage of justice” that he and his client would fight.

Carmack-Altwies told The Associated Press in a Jan. 19 interview that the set was “really being run pretty fast and loose” and that Baldwin should have known there had been previous misfires on the set and that multiple people had brought up safety concerns.

Baldwin and Gutierrez-Reed will be issued a summons to appear in court. The prosecutors will rely on the judge to determine if there is enough evidence to go to trial, instead of using a grand jury. It could take up to 60 days for decision.

The charges against Baldwin for Involuntary Manslaughter from “Rust” are a “flawed investigation”

Involuntary manslaughter can involve a killing that happens while a defendant is doing something lawful but dangerous and is acting negligently or without caution. Special prosecutor Andrea Reeb has cited a pattern of “criminal disregard for safety” on the set of “Rust.”

The terms of the plea agreement that was signed with David Halls, who oversaw safety on the set, will be released by prosecutors. Participants in the un-filmed rehearsal have given conflicting accounts of who handed the gun to Baldwin.

Defense attorney Jason Bowles, who represents Gutierrez-Reed, said the charges are the result of a “flawed investigation” and an “inaccurate understanding of the full facts.”

The decision to charge Baldwin marks a huge turn of events for the actor, who was an A-list actor in his 40 years, with the exception of “The Hunt for Red October” and “30 Rock.” Baldwin has often impersonated former President Donald Trump on “Saturday Night Live”.
